Please read this agreement carefully. These represent the Terms and Conditions for using the SafePay service, provided and maintained by the Conservative Party. If you do not agree to these, you may not use this service.

You are permitted to use the SafePay service solely on the basis of these Terms and Conditions. We reserve the right, at our discretion, to update and/or revise these Terms and Conditions without notice to you. Please check periodically for changes.

In this document, ‘us’ and ‘we’ refers to the Conservative Party, CCHQ and its suppliers and agents. ‘You’ refers to the Accounting Unit (usually an association or federation of the Conservative Party) that is using the SafePay service on its Bluetree website.

Using SafePay

By linking your SafePay account to your Bluetree website, you acknowledge that you are responsible for monies collected through your website using the SafePay service. 

SafePay is strictly only for use to collect money for the Accounting Unit (usually an Association or Federation of the Conservative Party). SafePay must not be used to collect monies for personal, business or any other use, without prior and explicit permission from us.

SafePay generates emails containing details of transactions. The email address to which these emails are sent is specified at the point of registration. If you plan to change this email address, then you are obliged to inform us with the new details immediately.

By using SafePay, you agree to pay a transaction fee of 2 per-cent on every transaction collected through SafePay on your website, and for this levy to be collected before any monies are transferred to your bank account. CCHQ also automatically collects a £5 membership fee from all memberships paid-for via SafePay. You do not need to pay this separately, as you would with memberships paid by any other means. We reserve the right, at our discretion to revise the transaction fee and the membership levy without notice to you.

If you use the ‘Disconnect’ button, you will no longer be able to use SafePay without reconnecting accounts. If you click the ‘Disconnect’ button accidently, please email us on [email protected] before reconnecting.

When an individual makes a payment through SafePay, their monies will be transferred electronically to a holding account owned by the Conservative Party, before being paid into your account.

If a transaction totals less than £500, it won’t require a compliance check and will be transferred immediately to the CCHQ holding account.

If a transaction totals over £500, it will be subject to a compliance check to ensure the donor is permissible. The Compliance team at CCHQ will carry out this check automatically. Once reviewed, if the donor is permissible, the Compliance team will mark the transaction as compliant, meaning it will then go into the CCHQ holding account. It is your responsibility to enter the donation into MERLIN and/or any other system you use once it has been approved.

If the donor is not permissible, the Compliance team will reject the payment. No funds will be taken from the donor’s account, and both you and the donor will receive a notification of the rejection.

CCHQ will credit your bank account on a monthly basis, with all funds accrued from transactions over the preceding month. You should receive an email notification every time your account is credited.

When an individual pays for a membership or makes a donation via SafePay, their details will appear in the ‘SafePay Membership’ or ‘SafePay Donations’ apps in your Bluetree control panel respectively. When an individual pays for tickets to an event on your website, their details will appear in the ‘Guest List’ tab on the page containing the event itself on your website.

It is your responsibility to manage this data, including but not limited to, entering information into MERLIN and other systems, managing guest lists for your events and sending further information about membership, donations and events to those who have made payment.

Refunds

When someone makes a payment to you through SafePay, the funds will always be transferred to a CCHQ holding account before being credited to your bank account.

While an individual’s funds are in the CCHQ holding account, we will take responsibility for issuing a refund where requested. Please contact [email protected] with details of any refund requests.

However, once funds have been credited to your bank account, CCHQ cannot issue a refund on your behalf, and it will not be possible to issue the refund through the SafePay system. Should someone request a refund after funds have been credited from the CCHQ holding account into your bank account, it is your responsibility to issue the refund and CCHQ cannot reimburse you for any transaction fees. We will, however, be able to refund the £5 CCHQ membership fee on membership subscriptions that are cancelled – should this happen, please contact [email protected] with proof of the cancellation.

Technical Problems

If you have any problems using SafePay, or problems are reported to you by individuals making a payment, you agree to contact us with details of the problem as soon as possible, giving as many details as possible so that we can identify the problem and work on a solution.

Privacy and Protection of Personal Information

Intellectual Property

The content, structure and design of SafePay and its integration with your Bluetree website is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display content on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print copies for the purposes of record-keeping, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content from SafePay without prior and explicit permission.

The concept, information architecture, structure, code, assets and any structural images relating to SafePay are strictly Copyright of Bluetree Website Services. Linking to SafePay

SafePay is a secure payment gateway that generates a unique Transaction ID whenever an individual initiates a payment by clicking on a button or link. SafePay can only be installed and used on a Bluetree website.

Because each action is unique, you must not copy any part of the code for use on another webpage within your website, any other website or email. You must not generate a QR code from a Transaction ID or copy or store Transaction IDs in any other electronic form, aside from the purpose of record-keeping.

The copying of code or duplication of any Transaction ID can cause technical faults within SafePay.

Software, documents and services

In no event shall we and/or respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of software, documents, provision of or failure to provide services, or information available from the services.

No unlawful or prohibited use

As a condition of your use of the services, you will not use the services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the services in any manner that could damage, disable, overburden, or impair any server or network(s) connected to any server owned or operated by the Conservative Party, its Associations, affiliates and representatives, or Parliament, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorised access to any Services, other accounts, computer systems or networks connected to any server owned or operated by the Conservative Party, its Associations, affiliates and representatives, or Parliament or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the services.
